Terms of service
These general terms and conditions of business govern the relations and prescribed conditions between MOTO ANDRO, trade business for services, owner Andrei Jeličić, Headquarters Put Duja 16, 21000, Split, MBO 98783076, OIB 39426721142 (lessor) and USER (lessee). The Lessor gives, and the User takes over the specified vehicle at use under the conditions stated below.
Part 1
Prices are based on the valid and public price lists on that day.
Part 2
In case of damage, theft, traffic accident, engine failure, etc., the user is obliged to keep the vehicle until collection from authorized persons from Moto Andro. The user is also obliged to write down names and addresses of witnesses and participants, immediately call the police and request the accident report and call the authorized persons from Motto Andro. In case of failure, also consult with Moto Andro. If the user does not submit a police record or if he does not make a statement, then the User will bear all the costs associated with that damage or disappearance. We remind the User that in case of negligent behavior towards the vehicle, documents or keys, as well as in other cases determined by the insurance law, may be charged with recourse compensation from the vehicle insurer.
Part 3
The insurance does not cover damage done intentionally, under the influence of alcohol, medicaments, drugs and intoxicants, without a driver's license, in cases of motorcycle/scooter transshipment. The insurance does not cover the risk of destruction or damage to tires, hubs and lower engine mounts.
Part 4
If Moto Andro demands in express and urgent situations from the User the return of the vehicle even earlier the agreed deadline, then the User obliges to do so. The user is obliged to return the vehicle correctly and undamaged in the condition the vehicle was in before the rental. The User is also obliged to return all downloaded documentation, keys, standard and additional equipment and tires. Payment is made by the User immediately when picking up the vehicle. The user should return the vehicle on the date and time previously agreed with Moto Andro. Business is conducted exclusively during the business hours indicated on our website/google/company door.
Part 5
The fuel policy is that you take the engine with a full tank and return it with a full tank because otherwise, the difference in the fuel shortage is deducted from the deposit, and the other fuel costs during the rental are borne by the User (normal running costs). Expenses incurred during vehicle rental regardless of time origination or manifestation, will be borne by the User in any sense, unless the costs are caused by Moto Andro's fault. These costs can be the User's negligence, costs such as tolls, garages, parking lots, fines for traffic and other violations, misdemeanor proceedings, default interest for the mentioned obligations and the like.
Part 6
If the user wants to extend the rental or make any changes, they should inform Moto Andro about it at least 1 day (24 hours) in advance so that they can organize and see if it is possible. In case that the User himself "extends the lease" without the consent and notification of Moto Andro, then we will consider that the vehicle is stolen and we will inform the authorities and the police in which case the User will bear all the associated costs. Delay in returning the vehicle is permitted in exceptional situations if Moto Andro approves it (if this situation occurs, it is mandatory to notify us). Any other delay is prohibited and is penalized by charging another full day of rental (a rental day is 24 hours) according to the MOTO ANDRO public price list on the day of return. Moto Andro has the right to know the location and the condition. In case it is determined that the User did not follow the rules and that he violated the provisions of this contract, the vehicle may be taken away by authorized persons. Moto Andro reserves the right to terminate the vehicle Rental Contract regardless of place and time and before the expiration of the period and does not bear any responsibility towards the User to compensate possible loss and damage.
Part 7
The Rental Contract is made in 2 identical copies, one of which is for the User and the other for the Lessor (Moto Andro). By signing the first page of this contract, the User accepts this contract with all its terms and conditions, which are concluded in the lessor's office. Amendments to this contract must be in writtten form only, oral agreements are not valid. The lessor's valid price list is integral part of this contract.
Part 8
By signing the Rental Contract, the User confirms that he has taken over the vehicle (motorcycle or scooter) with a full charge fuel tank in good condition without damage. The user confirms that he has taken the keys and necessary documents and equipment specified and described in the contract. A motorcycle or scooter can be picked up or returned at various locations with prior notice and agreement with the Moto Andro company. Unless otherwise agreed in advance, the user is obliged to return the rented vehicle exclusively to our office (address: Put Duja 16, Split - Croatia: See the map).
Part 9
Motorcycles / scooters are regularly maintained at an authorized service center and are thoroughly inspected before each rental, therefore Moto Andro is not responsible for injuries, death or damage that may occur to persons or the things that are driven in the vehicle.
Part 10
The user guarantees and obliges not to use the vehicle for illegal purposes and criminal acts, not to drive under the influence of drugs, alcohol and narcotic drugs and substances, not to violate customs regulations and rules and the like. The user is also obliged to take the keys and documentation when the vehicle is not in use. Our rented vehicles mustn't be used for: motor sports and other similar competitions, training races of other drivers, paid transport of goods, cargo and passengers, towing, haulage, transport of objects and goods that could damage the vehicle or destroy it in any way (for example sharp objects, animals, flammable material, etc). The user must not go on difficult off-road terrain, motocross races, jumps, violent terrain because for person own safety and the safety of the vehicle – an injured person in a remote and dislocated mountain is much more difficult to find and help than on a normal road. The user obliges to take over the rented vehicle and act in accordance with the Law of traffic safety on the roads and other applicable regulations, and that in the case of a breakdown, the user will immediately stop driving and notify Moto Andro. The user is obliged and guarantees that he /she will use the vehicle exclusively for own needs and that the vehicle will only be driven by the User or the person named in the contract as the driver (authorized person to drive the rented motorcycle in the contract) and guarantees correctness and validity of required driving license and required categories. Moto Andro should be informed about going out of Croatia. Rental possible only with valid documents and original documents brought in person (not photographed) - various types of certificates, papers and photographs are not valid for renting a vehicle at Moto Andro. If the user does not meet the required conditions and does not meet the requirements of Moto Andro, then we are obliged to prohibit that user from renting a vehicle from Moto Andro without obligations, debts and complaints. We are not responsible or pay or compensate for damages (for example, flights, accommodation, various expenses, arrangements and other).
Part 11
The User mustn't steal the vehicle, equipment, parts and any property, and he/she mustn't make any vehicle modifications and repairs. The User also cannot transfer rights or obligations from this contract to third party persons.
Part 12
The User confirms the validity and correctness of the requested documents by the part of Moto Andro. Driver's license is different for each vehicle depending on the cubic capacity. The required driving licenses are highlighted in motorcycle descriptions.
Part 13
The vehicle rental can be paid completely online or at the official address of our office on the day of vehicle pickups (bank transfers, cash and credit cards). A security deposit is possible only and exclusively to pay in cash. Payment must be made in full on the day of arrival to pick up the vehicle before the beginning of the lease, otherwise the lease will not be possible. The rental period is calculated per day period of 24 hours. One day rental basis is for a rental period of 24 hours starting from the moment of collection. Refunds are not granted for premature return of the motorcycle. For example, if you pick up the motorcycle at 12:00, you must return it by 12:00 o'clock.
Part 14 (Cancellation policy)
Cancellation due to bad weather
Moto Andro will not leave its guests in the lurch, and in case of impossible safe driving conditions, during the duration of the rental and on the day the rental begins (declared natural disaster from foreign country) return the full amount paid for the reservation. Bad and uncertain weather is a force majeure which we cannot influence on, therefore we will have understanding and act differently than in case of normal cancellations. Let's hope it doesn't come to this and that the weather will be acceptable for driving, but definitely we should not immediately be afraid of a short summer shower that will cool us nicely in the hot weather, after all, we are going on motorcycle adventures, not walking around the center. In case of travel cancellation as a result of bad weather that no one can influence on, Moto Andro disclaims any responsibility and is not responsible for additional costs or losses suffered by the participant (eg. costs for airline tickets paid in advance, hotel reservations, etc.). Don't be afraid, we definitely give free rain suits (jacket and trousers together).
Cancellation for private reasons
5 days (a day is counted as 24 hours) in advance free cancellation of the reservation, and in case of cancellation within 5 days, a deposit of 20% (non-refundable) that you paid for the reservation is taken. In case you have paid the full amount (100%) for the reservation, 20% of that amount is also taken (the other 80% is returned to the user) if you cancel within 5 days. In case of trip cancellation for private reasons, Moto Andro disclaims any responsibility and is not responsible for additional costs or losses that the participant underwent (for example, the costs of air tickets paid in advance, hotel reservations etc.).
Part 15
In case of any disputes arising from this contract, the parties agree that for all the disputes a competent court in Split will be in charge.
